The rules for using Keen.

1. About these terms

These terms govern your use of the Keen app and website, operated by CONFIRM: legal entity name ("Keen"). By using Keen you agree to them. CONFIRM: Confirm acceptance mechanism and minimum age.

2. Keen's role

Keen is a marketplace that connects customers with independent beauty and wellness providers. CONFIRM: Confirm: Keen is not the provider of services; the service contract is between customer and provider. Providers are responsible for the services they deliver.

3. Accounts

You must give accurate information and keep your sign-in details secure. CONFIRM: Confirm account rules and suspension rights.

4. Bookings and discounts

Providers publish appointments and set the discounted price and terms. A booking is confirmed when CONFIRM: confirm trigger, e.g. app confirmation. Discounts apply only to the listed appointment and CONFIRM: confirm any restrictions or expiry.

5. Payments

CONFIRM: Confirm whether customers pay in-app or at the provider, which processor is used, when charges occur, and any Keen fees or commission charged to providers.

6. Cancellations and no-shows

CONFIRM: Confirm the cancellation window, who sets it (Keen or each provider), any fees, and no-show handling. Must be shown to customers before booking.

7. Refunds

CONFIRM: Confirm refund process, who decides, timeframes, and how this aligns with the Consumer Guarantees Act 1993 and Fair Trading Act 1986. Statutory rights are not excluded.

8. Provider responsibilities

Providers must:

• hold any qualifications, licences and insurance their services require CONFIRM: confirm requirements;
• keep availability, prices and descriptions accurate and honour listed bookings;
• deliver services with reasonable care and skill and comply with NZ law, including health and safety;
• handle customer information only as needed for the booking and in line with the Privacy Act 2020.

CONFIRM: Confirm provider onboarding terms, fees and payout timing.

9. Acceptable use

You must not misuse Keen, interfere with it, scrape it, or use it unlawfully. CONFIRM: Add specifics.

10. Liability

CONFIRM: Liability limits and disclaimers must be drafted by a lawyer. Nothing here limits rights that cannot be excluded by NZ law.

11. Termination

CONFIRM: Confirm how users and Keen can end the relationship. See Account Deletion.

12. Governing law

CONFIRM: Confirm: New Zealand law and NZ courts.
